 owned and operated by Maragiya.com, ("Maragiya," "Us" or "We"). These
 terms and conditions (The "General Terms and conditions of use") govern
 your  ("Buyer") use of, access to, and purchase of products at the Site
 and your conduct on the Site and the Site's privacy policy. You agree to comply 

with and be bound by these general terms and conditions of use. To order goods
 using this website the customer must be at least 18 years of age. Please
 refer to this page frequently to review our current terms and conditions
 of use/legal statement. When you use this website, you are automatically
 agreeing that both your access to the site and your use of it are:

 1.Binding Agreement
 Our order confirmation, these general terms and conditions of sale and our
 other site policies shall be deemed the final and integrated agreement
 between you and us on the matters contained in these general terms and
 conditions of sale.

 understand and unambiguously consent to the collection and processing of
 such information in the United States. For further information data,
 please see our privacy policy. We control and operate the Site from our
 offices in the United States of America, and all information is processed
 within the United States or at the location of our service providers. We

 applicable laws regarding the transmission of data exported from the
 United States or the country in which you reside as well as the
 restrictions on import of Items to your country.

 When applicable, prices displayed on the Maragiya.com website are shown in

 U.S. dollars and do not include taxes. Prices are provided for
 informational purposes and are not binding. Please also note that
 prices shown may vary between the U.S. mainland, Hawaii, Guam
 and Saipan. The price displayed is based on such jurisdiction as
 inferred from your computer IP address. Prices remain subject to change
 without notice.The total amount due is inclusive of sales tax applied in
 accordance with applicable state and local regulations based on your
 shipping address.  The applicable sales tax amount is indicated on the
 payment page of the cart.The amount of sales tax charged on your order
 will depend upon various factors, including type of item purchased, sales
 price and destination of the shipment. Sales tax regulations may change
 between the time you place an order and the time of credit card charge
 authorization and this may affect the calculation of sales taxes. The
 amount appearing on your payment page of the cart may differ from the
 sales taxes ultimately charged as indicated in the invoice you will
 receive with the shipping confirmation-email.

 As between you (the "Buyer") and Maragiya, (or the respective company),
 Maragiya.com is the owner and/or authorized user of any trademark,
 registered trademark and/or service mark appearing on the Site, All
 content included on www.maragia.com site, such as text, works,
 images, pictures, dialogues, music, sounds, audio clips, videos, digital
 downloads, documents, data compilations, drawings, figures, logos, menus,
 web pages, graphics, colors, schemes, tools, button icons, fonts,
 designs, diagrams, layouts, methods, processes, functions and
 software both individually and as they are compiled on the site (
 collectively, the "content"), is the property of Maragiya.com or its
 content suppliers. You may not reproduce, publish, distribute, display,
 modify, lease, loan, sell, create derivative work from or exploit in any
 way, in whole or in part, the content without the prior express written
 consent of Maragiya.com, or its content suppliers, as the case may be.
 Any commercial use of the Site is strictly prohibited, except as allowed
 herein or otherwise approved by us. You may not download or save a copy
 of any of the Content or screens for any purpose except as otherwise
 provided by Maragiya.com. Maragiya.com and its content suppliers shall
 have the exclusive right to authorize or prohibit in their sole
 discretion any reproduction, publication, distribution, display,
 modification, creation of derivative work from, or exploitation in any
 way of, in whole or in part, the content. Maragiya.com and it content
 suppliers shall have the right, at any time, to claim the authorship of
 any content posted on this site and to object to any use, distortion or
 other modification of such content, any reproduction, publication,
 distribution, display, modification, creation of derivative work from or
 exploitation in any way of, the content expressly authorized in writing
 by Maragiya.com or its content suppliers, shall be carried out by you for

 or phrases may be protected under law as the trademarks, service marks or
 trade names of Maragiya.com, or other entities. Such trademarks, service
 marks and trade names may be registered in the United States and
 internationally. Without our prior written permission, you agree not to
 display or use our trademarks, service marks, trade names, other
 copyrightable material or any other intellectual property in any manner
 images created or produced or modified by Maragiya.com. All images
 created or produced or modified by Maragiya.com are the sole property of
 Maragiya.com. Maragiya.com may use any such image to promote the Site or
 for any other purpose at any time without restriction.The trademarks or
 trade dress of Maragiya.com and our affiliates may not be used without
 our written permission. Trademarks or trade dress include the Maragiya
 name and logo, and other graphics, logos, page headers, button icons,
 scripts, and service names of Maragiya.com products, services, and
 programs, and those of our affiliates. All other trademarks that appear
 on this site are the property of their respective owners, who may or may
 not be affiliated with, connected to, or sponsored by us or our
 affiliates.

 Maragiya.com expressly reserves the right to terminate the use of, or to refuse to 

 permit the use of the Site by any person or entity, at the sole discretion of Maragiya.com for
 any reason or no reason at all, and without prior notice.

7. Eligibility
 to Use the SiteYou must be 18 years of age or older to use this Site.
 This Site is not directed at children under the age of 18 and does not
 knowingly or intentionally collect or maintain any Personal information
 from such children. The Site is designed for persons with experience
 with, and who are accustomed to, buying Items based on photographs and
 the Buyer represents having such experience. If you believe that we
 might have any Personal Information from or about anyone under the age of
 18, please reach us at the contact information provided below under
 section 8.

Registration may be required in order to use the Site.Registrants are required to provide
 certain information and to select a password to be used to create and
 access their accounts. This password and other registration details
 should be kept safe and not shared with anyone. Registrants may
 voluntarily provide additional information in the registration process to
 personalize their accounts. Registrants may access their accounts to view
 their profile information as well as transaction information by clicking
 the icon on the home page of the Site after logging in.Buyers may cancel
 their registration and account at any time. For your security, requests
 to terminate accounts MUST originate from the registered email account at
 Maragiya.com addressed to shopmaragiya@gmail.com. Under no circumstances
 will a cancellation request received via the phone or otherwise be
 accepted.

9. Pricing and availability; Site unavailability 

 Due to the nature of the internet, occasional glitches, service interruptions or

 mistakes may cause unintended inaccuracies to appear on the Site.
 Maragiya.com has the right to correct inaccuracies or mistakes that come
 to its attention and to void any purchases of Items that display an
 inaccurate price or description. You acknowledge that temporary
 interruptions in the availability of the Site may occur from time to time
 as normal events. Also, we may decide to cease making available the Site
 or any portion of the Site at any time and for any reason. Under no
 circumstances will Maragiya.com  be held liable for any damages due to
 such interruptions or lack of availability. Because most of the Items
 displayed on the Site are unique and are offered by Maragiya.com that
 usually has retail opportunities for the sale of the Item independent
 from the Site, all Items displayed on the Site are offered for sale
 strictly subject to availability.The Buyer is aware that unless otherwise
 stated, most of the collectible and vintage Items are not new nor in perfect 

condition and may require touch-up or repairs prior to use and that the available
 information about these Items may be limited. The Site is designed to
 provide the Buyer access to Items as the Maragiya.com presents them. 

 All orders are subject to e-mail confirmation by Maragiya.com. 

 Please note that the products displayed on this site may be
 out-of-stock or discontinued, and availability is not guaranteed. Please
 note that while we have tried to accurately display the colors of
 products, the actual colors you see will depend on your monitor and may
 not be accurate. 

 11. Product information
 Maragiya.com handcrafted, collectibles and vintage products are uniquely made and are
 therefore subject to slight variation, as is the nature of crafted goods;
 this is part of the charm of these items. Please take this into
 consideration when making a purchase. Please view the pictures for
 conditions.

 Immediately upon receipt of
 the Sale Confirmation, the Buyer shall remit an amount equal to 100% of
 the Total Purchase Price. The Buyer hereby irrevocably authorizes
 Maragiya.com upon Sale Confirmation to charge the Buyer's credit card
 or other payment methods for an amount equal to the Total Purchase
 Price.If for any reason after receipt of the Sale Confirmation, Buyer
 cancels a payment made by credit card or any other means or the Buyer
 otherwise fails to make any payment(s) with respect to the Total Purchase
 Price, Buyer shall remain liable to the Dealer for the full Total
 Purchase Price and any costs related to the sale of the Item including
 but not limited to taxes, storage and handling fees if applicable and any
 costs incurred by Maragiya.com associated with collecting any amount due
 to the Dealer including but not limited to legal fees and costs related
 to currency fluctuations. Without limitation to the preceding sentence and
 in addition to any other remedies at law or equity, in the event of Buyer
 default, Maragiya.com reserves the right, at its election, to retain any
 and all payments paid by Buyer prior to Buyer default with respect to the
 Item and to cancel the sale of the Item without any further obligation to
 Buyer. The Buyer acknowledges and agrees that damages to Maragiya.com in
 the event of Buyer Default will be difficult or impossible to prove and
 that the paid amount is reasonable compensation to Maragiya.com for
 damages suffered and constitutes liquidated damages and not a penalty.

13. Disclaimer of liability
 Use of and browsing in the Sites are at your own risk. We make no
 representations or warranties of any kind, whether express or implied,
 with respect to this website, its content, or the information available
 on or through it; To the extent permitted by law and without limiting
 any of the foregoing, everything on the Sites is provided to you on
 an "as is," with all faults, without warranty, either express or
 implied, of any kind, including, but not limited to, the implied
 warranties of merchantability, fitness for a specific purpose, freedom
 from computer virus, or non-infringement. Except as otherwise provided
 under applicable laws, we and our employees, agents, contractors,
 successors and assigns of each, will not be liable for any damages
 whatsoever arising out of or related to the use of this website or any
 other website linked to it. This limitation of liability applies to
 direct, indirect, consequential, special, punitive, or other damages you
 or others may suffer, as well as damages for lost profits, business
 interruption, or the loss of data or information, even if we are notified
 in advance of the potential for any such damages. Because some
 jurisdictions do not allow limitations on implied warranties, or
 limitation of liability for consequential or incidental damages, the

14. Cancellation of Order/Right of Cancellation
 The Buyer must inform Maragiya.com of its decision to cancel the order in
 writing to shopmaragiya@gmail.com within a 3 business day period which begins
 from the date of purchase. Maragiya.com will reimburse all payments
 received from this Buyer for the Items purchased and the Buyer will incur
 no fee as a result of such reimbursement. 

15. Returns and Refunds
 Please refer to our  Return and Refund Policy, which forms an integral
 part of these general terms and conditions of sale.

16. Sales are
 "As-Is"All Items displayed on the Site are sold "AS IS".  Maragiya.com
 does not make any guarantee, warranty or representation, expressed or
 implied, to any Buyer with respect to any Item, including without
 limitation, its condition, merchantability, fitness for a particular
 purpose, quality, rarity, importance, provenance, designer or creator,
 exhibitions, literature, historical relevance or otherwise. No statement
 anywhere, whether oral or written, shall be deemed any such guarantee,
 warranty or representation. Maragiya.com makes no representation or
 warranty as to whether the Buyer acquires any reproduction rights or
 other intellectual property rights in any Item.

17. Transfer of Title/Risk of Loss

Each Item sold on the Site represents that it will convey clear
 title of each  Item to the Buyer upon receipt by Maragiya.com or his/her
 agent of their Total Purchase Price for the Item. In the event that
 Maragiya.com has requested that his/her agent collect and remit payment
 of the Total Purchase Price, then the Maragiya.com will convey clear
 title to the Item upon receipt of the Sales Confirmation by the Buyer and
 receipt by the agent of the Total Purchase Price.

18. Buyer Business Practices and Obligations
 We expect and require Buyers to comply with the following business
 practices:(i) Buyers shall treat all  representatives of Maragiya.com
 with respect and without discrimination;(ii) Buyers shall provide
 accurate account information and keep contact information up to date;
 and(iii)  Buyers shall make payment immediately, via major credit card
 with sufficient available balance or other means to pay the Total
 Purchase Price when it becomes due.

19. Refusal of Transaction
 Maragiya.com reserves the right to withdraw any Item from the Site or to
 amend any content on the Site at any time in its sole discretion.
 Maragiya.com may refuse service to anyone at any time in its sole
 discretion. Maragiya.com will not be liable to any Buyer or any other
 third party because it has withdrawn any Item from the Site, amended any
 of the content or denied access to the Site.

20. Modification to Site; Monitoring

We reserve the right, for any reason, in our sole discretion
 and without notice to you, to terminate, change, suspend or discontinue
 any aspect of the Site, including, but not limited to, information,
 products, data, text, music, sound, photographs, graphics, video,
 messages or other materials ("Content"), features and/or hours of
 availability, and we will not be liable to you or to any third party for
 doing so. We may also impose rules for and limits on use of the Site or
 restrict your access to part, or all, of the Site without notice or
 penalty. We have the right to change these rules and/or limitations at
 any time, at our sole discretion.

 The provider and Maragiya.com do not Linked Sites are not, however,
 reviewed, operate, endorse or guarantee controlled or examined by us in

Provider shall not be liable for any delay or failure in
performance caused by circumstances beyond its reasonable control.
